Many judges are willing to strike down the “state of emergency” orders issued by our governors. In Massachusetts, for example, gun stores disputed their designation as “non-essential” and won the right to reopen. In New Jersey and Wisconsin, citizens successfully challenged their governors’ stay-at-home orders. These decisions should encourage anyone who has been negatively affected by a governor’s emergency orders to consider legal action against the state. Unless these orders are challenged in court, they will remain in effect indefinitely and the “new normal” will be here to stay.
