
As businesses begin reopening in Massachusetts, many business owners are asking their visitors to sign COVID 19 disclaimers. Such disclaimers should contain, at the very least, the following provisions: (1) the visitor is releasing the business owner from any liability associated with COVID 19 in exchange for permission to enter the business; (2) the visitor acknowledges the risks associated with COVID-19; and (3) despite the acknowledged risks, the visitor is still willing to enter the business.
