If you’re arrested for drunk driving in Massachusetts, officers will advise you that you have the right to refuse taking the breathalyzer test. By refusing the test you often make it very difficult for prosecutors to prove “impairment” beyond a reasonable doubt at trial. This, of course, is a good thing if you intend to dispute your case in court. The downside is that you lose your license for a minimum of 180 days if/when you refuse the breath test.
