
Today boston.com reported that Quincy’s commissioner of public health, Marli Caslli, has been charged with drunk driving.
According to the article, Caslli was stopped by a state trooper while allegedly driving over 100 mph on Route 3 South in Weymouth at around 2 a.m.
Caslli reportedly told the trooper that he was returning home from a restaurant in the Seaport District of Boston where he had the proverbial “two drinks.”
The trooper claims that Caslli failed most of the field sobriety tests. Additionally, the trooper supposedly observed the common indicia of intoxication–bloodshot/glassy eyes, slurred speech, and the odor of alcohol.
Boston.com reports that Caslli took the breath test, though its unclear whether he took the portable breath test (which is usually inadmissible at trial) or the OAT certified breathalyzer at the police station.
Either way, his blood alcohol level (BAC) was fairly low: 0.097%. Yes, that’s slightly over the legal limit of 0.08%. But the case may still be very defensible.
