
The Department of Labor filed a lawsuit against Boston Musicians’ Association, Local 9-535 of the American Federation of Musicians (the “Union”).
The complaint (attached below) claims that the Union failed to comply with federal law and with its own bylaws when electing its secretary-treasurer and board of directors in December 2025.
According to the Union’s bylaws, members must be in good standing (with their dues fully paid) for two consecutive years before running for election.
The Union allegedly permitted some members to run for election even though they were not in good standing.
At the same time, the Union allegedly barred other members from seeking election because they were not in good standing.
The Department of Labor is asking the court to void the 2025 election for the Union’s directors and secretary-treasurer.
Additionally, the Department of Labor is seeking a court order directing the Union to redo its December 2025 election.
