Mandatory jail sentences often backfire. Why? Because they force criminal defendants to dig in their heels and fight their charges all the way to trial.
This leads many prosecutors to either dismiss charges with mandatory minimum sentences or (more likely) amend the charge down to something less serious without required jail time.
